Terms of Use

These terms are an agreement between you and Pejman Parsa, an individual, who publishes and operates Vitrine and Vitrine Studio. They cover this website, the desktop app, the control-plane API, and the Shopify Admin app. The privacy page describes what is stored. It is not replaced by these terms. Acceptance

By visiting this website, creating an account, downloading or running the desktop app, installing the Shopify app, or otherwise using the services, you agree to these terms. If you do not agree, do not use Vitrine. If you use Vitrine for a business, you confirm that you have authority to bind that business.

The service

Vitrine is a local listing studio for product images.

  • The desktop app scans, cleans, and localizes product images on the merchant's own computer. That work does not require sending those pixels to a paid AI model host. The default install includes no paid AI service.
  • The control-plane API and the Shopify Admin app are hosted on Fly. The API keeps the account and, when you install the Shopify app, an encrypted shop token so Apply can run. The desktop app does not hold the Shopify Admin token.
  • Apply writes approved images to your Shopify store only when someone chooses Apply in the Admin app. Local folder jobs stay in the job folders on the PC and are not published to Shopify from the desktop app.

Vitrine is a tool you operate. It does not run your store, approve your listings, or act as the seller of your products.

Accounts

Creating an account stores an email address and a password hash on the API. That account is how a desktop device pairs. You are responsible for your email, your password, and every device you pair. Do not share an account or a pairing code to get around a plan limit. You must use a current email you control, because notices under these terms may be sent there.

Plans and payment

Vitrine offers a Free plan and a Pro plan. Pro is $19 per month, charged only through Shopify App Pricing. Shopify is the merchant of record for that subscription. Vitrine does not collect card numbers and does not bill you through Stripe or PayPal. What each plan includes is described on the pricing page and in the Admin app.

The charge, any tax Shopify collects, and Shopify's refund process are governed by Shopify's terms, not by a separate payment contract with Pejman Parsa. Cancelling or changing Pro is done in Shopify. Unpaid or cancelled plans may return the store to Free limits.

Acceptable use

You may use Vitrine for your own catalog work, in line with these terms. You will not:

  • use the website, the apps, or their output to break the law or to infringe someone else's rights;
  • probe, scrape in a way that degrades the service, overload, disrupt, or bypass the API, the plan caps, or other access controls;
  • upload malware, or use the service to attack Shopify, Fly, or any other system;
  • copy, modify, or distribute the software except as these terms or applicable law allow;
  • reverse engineer, decompile, or try to extract source code, except for the limited interoperability right that applicable law (including mandatory European rules) does not allow a contract to remove;
  • rent, resell, or present Vitrine as your own product, or claim that Pejman Parsa is a company, Shopify, or anyone other than the individual publisher of this service.

Your content and your listings

You keep ownership of your images, catalog data, and store listings. Pejman Parsa does not claim ownership of that content and does not sell your catalog pixels.

You grant a limited permission to host the account data the service needs, to keep the shop connection required for Apply, and to send approved images to your Shopify store when Apply is chosen in the Admin app. That permission exists only to provide the service you asked for. The privacy page describes what the API stores. Uninstalling the Shopify app disables Apply and drops the shop token.

You confirm that you have the rights required to process and publish the images and text you use with Vitrine. You are solely responsible for:

  • the accuracy of your store listings, including product descriptions, prices, and claims you publish;
  • any intellectual-property or other claim a third party brings about your images, text, or catalog;
  • compliance with Shopify's terms and policies, and with the rules of any marketplace you sell on.

Vitrine does not review your catalog for legal clearance and does not clear copyright, trademarks, or advertising claims. You decide which images are approved and which ones are applied to the store.

To the maximum extent permitted by French law, you agree to cover claims, damages, and reasonable costs that Pejman Parsa incurs because of your content, your listings, your stores, or your breach of these terms, including a third party's claim that an image or listing you processed or published with Vitrine infringes their rights. This does not require you to cover a loss to the extent it was caused by Pejman Parsa's fraud, wilful misconduct, or gross negligence, and it does not apply where a mandatory consumer protection forbids it.

No guarantee of results or uptime

Vitrine does not guarantee sales, revenue, conversion, search ranking, SEO, advertising performance, or any other business result. Cleaning and localization can be wrong, incomplete, or unsuitable for a listing. You must check the output before it goes live on a store.

The website, the API, the Admin app, and the desktop app are not guaranteed to be uninterrupted, timely, secure, or error-free. Maintenance, updates, your computer, your network, Shopify, and Fly can each stop a job. There is no service-level agreement.

Third-party services

Shopify, Fly.io, your operating system, Microsoft (including SmartScreen, Smart App Control, and the Microsoft Store), Apple, and other third parties are not operated or controlled by Pejman Parsa. Their availability, fees, review decisions, and policy changes are their own. Vitrine is not responsible for a store action Shopify refuses, for an app-store or certificate warning, or for an outage of a host it does not control. Your use of those services is also subject to their terms.

Updates

The desktop app may contact the control-plane API to check for a newer version. On a frozen Windows or Mac install it may download a package, check its hash, and replace the local application. A required update may pause scan and queue work until that update is installed. Quitting the app remains available. A Mode B script install is not rewritten in place; the app points you to the package on this website. A Microsoft Store install is updated by the Store, not by that package replacement. If you do not want a newer version, stop using the app.

These terms may also change. The updated text will be posted on this page with a new "Last updated" date. Posting on this page is the notice. If you keep using the website, the apps, or the services after that date, you accept the updated terms. If you do not agree, stop using Vitrine and uninstall the apps. A change does not apply backward to a dispute that already exists, except where the law requires it.

Disclaimer of warranties

The website, the desktop app, the Admin app, the API, and the documentation are provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by French law, Pejman Parsa disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy, and any warranty that the service will be uninterrupted or error-free. Output from Vitrine is not legal, tax, or compliance advice.

Some rights cannot be disclaimed, including certain mandatory consumer rights. This section does not remove those rights.

Limitation of liability

To the maximum extent permitted by French law, including French consumer law and commercial law:

  • Pejman Parsa is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost sales, lost revenue, lost goodwill, lost data, or business interruption, whether or not such loss was foreseeable or he had been advised it was possible.
  • Pejman Parsa's total liability for all claims relating to the service arising in any twelve-month period is limited to the greater of (a) the amounts you paid for Vitrine through Shopify during the twelve months before the claim and (b) one hundred euros (EUR 100).

Nothing in these terms limits or excludes liability that cannot legally be limited or excluded. That includes liability for death or personal injury where the law forbids a limit, liability for fraud, wilful misconduct (dol), or gross negligence (faute lourde), and any non-waivable right a consumer has under mandatory French or European Union law. If a court holds that a limit cannot be enforced as written, that limit applies only as far as the law allows, and the rest of these terms still apply.

Suspension and ending use

You may stop at any time. Uninstall the desktop app, and uninstall the Shopify app if you connected a store. Uninstalling the Shopify app disables Apply.

Pejman Parsa may suspend or end an account, a paired device, Apply, or access to the website if you breach these terms, if your use puts the service or other people at risk, if the law requires it, if a Shopify plan is unpaid or cancelled, or if the service is discontinued. Where it is reasonable and the law allows it, notice will be sent to the account email. Suspension may be immediate in the case of abuse, a security issue, or a legal requirement.

The sections that should sensibly continue after you stop — including your responsibilities for content and listings, the warranty disclaimer, the limit of liability, and governing law — continue to apply.

Governing law and disputes

These terms are governed by the laws of France. The courts of France have jurisdiction over disputes arising out of these terms or the service.

If you are a consumer, mandatory protections of the law of your place of residence still apply where that law says they cannot be waived, and you may still have the right to bring proceedings in the courts of that place. A choice of French law and French courts does not take those mandatory rights away. If you use Vitrine in the course of a business, you agree that the courts of France have jurisdiction.
